Section 8e Compliance Procedures  
An importer complies with Section 8e of the Agricultural Marketing Agreement Act of 1937 by completing either:

 
Having the shipment inspected for size, grade and quality requirements to receive a United States or Canadian inspection certificate. The Canadian inspection certificate is only honored for tomatoes, potatoes and onions. Contact the appropriate fresh commodity inspection office or processed commodity inspection office prior to entry for specific details on how to obtain release from the U.S. Customs and Border Protection Service. Note that a quality inspection and release issued by the Agricultural Marketing Service is a different inspection and release issued by the Animal and Plant Health Inspection Service.

Filing a properly executed Importers Exempt Commodity Form (FV-6) with the U.S. Customs and Border Protection Service and the Agricultural Marketing Service’s Marketing Order Administration Branch for commodities destined for processing, animal feed, charity relief, certified seed, government agencies, or other exempt outlets (requirements vary according to commodity).
